Terms and Conditions
These Terms and Conditions govern access to and use of the Salesgraph website, platform, and related services. They are designed for a product that connects to third-party systems, analyzes sales and customer engagement data, and generates workflow outputs, summaries, and recommendations for revenue teams.
Acceptance
By accessing or using Salesgraph, you agree to these Terms and Conditions. If you are using the service on behalf of a company or other entity, you represent that you have authority to bind that entity to these terms.
Eligibility and Accounts
You must provide accurate information, keep account credentials secure, and promptly notify us of unauthorized use. You are responsible for activity that occurs under your account and for managing access rights for your users, administrators, contractors, and connected systems.
Use of the Service
You may use Salesgraph only in compliance with applicable laws, these terms, and any applicable order form or commercial agreement. You may not:
- Use the service to violate privacy, employment, consumer protection, or recording laws.
- Upload, connect, or process data that you do not have the right to use, disclose, or instruct us to process.
- Interfere with the service, circumvent security controls, probe vulnerabilities, or access the service in unauthorized ways.
- Reverse engineer, copy, resell, frame, mirror, or create derivative works from the service except to the extent such restriction is prohibited by law.
- Use the service to build a competing product or to benchmark the service for public disclosure without our prior written consent.
Customer Data and Integrations
Salesgraph is designed to connect with third-party tools used by sales, customer success, support, marketing, and operations teams. By enabling an integration or providing access credentials, you instruct us to access, process, store, transmit, and display relevant data from those systems in order to provide the service.
- You are responsible for obtaining all rights, notices, and consents needed for us to process emails, meeting data, recordings, transcripts, CRM data, Slack or similar messages, attachments, and other customer data made available through the service.
- You remain responsible for the content, accuracy, legality, and quality of customer data, as well as the configuration choices that determine what information is shared with Salesgraph.
- Third-party services are governed by their own terms, privacy policies, and technical limitations. We are not responsible for third-party products, outages, API changes, or data handling outside Salesgraph.
Ownership and Rights
As between the parties, you retain ownership of customer data. You grant Salesgraph the rights necessary to host, copy, process, transmit, analyze, and display customer data for the purpose of operating, securing, improving, and supporting the service.
Salesgraph and its licensors retain all rights, title, and interest in the service, software, documentation, branding, interfaces, workflows, and product outputs other than customer data. We may use usage data, telemetry, and de-identified or aggregated information to operate and improve the service.
AI and Automated Features
Salesgraph may provide summaries, classifications, alerts, forecasts, recommendations, or other automated outputs. These outputs may be probabilistic, incomplete, or inaccurate and should be reviewed by appropriate personnel before being relied on for business, employment, legal, compliance, or financial decisions.
Fees, Suspension, and Termination
Some parts of the service may require payment under a separate order form, subscription, or pricing agreement. Unless otherwise stated in writing, fees are non-cancelable and non- refundable except as required by law.
We may modify, suspend, or discontinue any part of the service at any time. We may also suspend or terminate access if we reasonably believe there is a security risk, legal risk, non-payment issue, or violation of these terms.
Disclaimers and Limitation of Liability
Salesgraph is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
To the fullest extent permitted by law, Salesgraph will not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunities, even if advised of the possibility of such damages.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Salesgraph, its affiliates, and their personnel from claims, damages, liabilities, costs, and expenses arising from your use of the service, your customer data, your violation of these terms, or your violation of applicable law or third-party rights.
Changes and Contact
We may update these Terms and Conditions from time to time. Updated terms become effective when posted unless a later date is stated. Your continued use of Salesgraph after the effective date constitutes acceptance of the updated terms.
